An analysis of the Harmony Gold / Battletech legal dustup
Our friend Chris Matthews (aka Robotech Master) posted an amazingly detailed and well-written account of the legal issues underpinning the recent legal dispute set off by the Mechwarrior 5 trailer. There is far too much legal wrangling to summarize effectively, but Matthews’ assessment seems spot-on: nobody but former FASA execs and Harmony Gold know exactly what the terms of the legal settlement are.
Jordan Weisman, founder of FASA and Smith and Tinker (who produced the trailer) is definitely one of those people, and unless he is trying to skirt some loophole in the agreement, he should definitely know better. Beyond that, just who holds (and can defend) the legal rights to the mecha designs in question is a mystery. One that may finally be hashed out in court. It seems to me that it might be best if a judge were to make a ruling, instead of both parties making a back-room deal which is constantly in jeopardy of being compromised.
